Primero Justicia Región Exterior, denuncia ante las organizaciones Internacionales y la Opinión Publica internacional el nuevo golpe de estado legitimado este viernes (12-17-2010) Por la Asamblea Nacional. "Ley Habilitante"

Denunciamos:

1.- Que es violatorio a la Constitución nacional que: el presidente venezolano Hugo Chávez termine su mandato en 2012 con poderes especiales para legislar, una prerrogativa que le permitirá "anular" a sus opositores en el nuevo Parlamento y encarar con "comodidad" sus aspiraciones de reelección.

2.-Que es bien claro que: Chávez, quien asumió el poder por primera vez en 1999, logró una enmienda a la Constitución en 2009 para poder ser candidato en los próximos comicios presidenciales de diciembre de 2012.

3.- Que Chávez, en el último tramo de su segundo mandato, se "garantiza con la 'ley habilitante' una comodidad política" al "anular a la oposición en la nueva Asamblea Nacional". Al nuevo Legislativo que asumirá funciones en enero y en el que los diputados de oposición ocuparán 67 de los 165 escaños. A partir de entonces, el Partido Socialista (PSUV, en el poder) perderá la aplastante mayoría que tuvo durante los últimos cinco años, cuando legisló frente a una ínfima disidencia.

4.- Que la solicitud inicial era que los poderes se extendieran por un año, pero respondiendo a una petición de los "propios afectados", los parlamentarios aprobaron elevar el lapso a 18 meses."Ninguna delegación puede sobrevivir al delegante, y ésta es una delegación concedida por un Legislativo a punto de terminar sus funciones".

5.-Que Chávez, con sus nuevos poderes, podrá legislar en los siguientes ámbitos: necesidades urgentes derivadas de la pobreza y las lluvias, infraestructura, transporte y servicios públicos, finanzas y tributos, seguridad y defensa, cooperación internacional, vivienda, ordenación territorial y uso de la tierra urbana y rural, atribuyéndose todo el poder en sus manos.

6.-Que Hugo Chávez, adelantó esta semana que tiene "casi listas" unas 20 leyes, sin precisar detalles. Hasta ahora, sólo ha adelantado que estudia aumentar el IVA para recaudar dinero que irá a un fondo especial creado para atender la emergencia.

7.- Que Hugo Chávez, ha utilizado poderes especiales para legislar en 2000, 2001 y 2008, periodos en los que aprobó por decreto más de 100 leyes.

8.- Que el

PODER POPULAR" no es más que una manipulación mediática para después burlarlo. Es la utilización del pueblo y su soberanía, propia de una democracia, para simular que existe mientras se construye una autocracia totalitaria. Una copia servil del sistema castrista. Hablan de libertades para el pueblo y después lo dejan sin libertades. Hablan de justicia social para los más pobres y crean una nueva oligarquía de burgueses oficialistas que se enriquecen a costa de ese pueblo. Engaño tras engaño, promesas tras promesas que terminan imponiendo una sociedad esclavizada y hambrienta “hecha en socialismo”.

9.- Que la "SIMULACIÓN INSTITUCIONAL". Que este régimen mantiene los poderes propios de un Estado democrático para simular que existen instituciones pero lo cierto es que todos los poderes del Estado los ejerce el Ejecutivo a través de funcionarios –súbditos. Ahora temiendo que se le escape de las manos el Poder Judicial se adelantó y designó sus Magistrados en el Tribunal Supremo de Justicia (T.S.J.) para que sigan impartiendo una justicia parcializada, o sea, chucuta. AsÍ, es como se gobierna en socialismo.

Terminamos esta denuncia puntualizando nuestros requerimientos:

1.-Planteamos al mundo entero la clara determinación de buscar la vía para lograr una salida de las cadenas totalitarias que

nos han mantenido dominados hasta estos días, pretendiendo perpetuarse en el poder en las próximas elecciones presidenciales de nov. del 2012.

2.-Solicitamos que las instancias internacionales que aplique de inmediato la Carta Democrática Internacional en Venezuela, país que se ha apartado del hilo Constitucional, violando claramente esta carta Magna.

3.-Solicitamos que se eleve esta situación a la consideración del Consejo Permanente de la OEA para que la trate con la urgencia del caso, “a fin de que no se les continúe violando a estos cuatro parlamentarios (Biagio Pillieri, José Sánchez, Richard Blanco y Hernán Alemán) sus derechos humanos”.

4.- Que las OEA y otras organizaciones internacionales se aboquen a garantizar que a los diputados de la oposición no les sea allanada la inmunidad parlamentaria por decisión discrecional del Presidente de la República, previendo esta clara intencion hecha publica por Hugo Chávez.

5.-Que se condene la habilitación del Presidente la cual, usurpa la competencia de los diputados electos y hace nugatoria su actuación, “lo que constituye una evidente violación de la voluntad popular y las normas constitucionales en materia de habilitación legislativa, ya que los actuales parlamentarios no podrían delegar sus funciones en un lapso que exceda aquel para el cual fueron elegidos”, violando claramente la Constitución y las leyes vigentes en el país.

6.-Por ultimo solicitamos que esta situación tan grave es a nuestro juicio una decisión que conculcaría el estado de derecho en Venezuela y supone una violación a las normas contenidas en la Carta Democrática aprobada por la OEA y en tal sentido lo denunciamos para que ésta organización proceda en consecuencia.
